Mediation, arbitration may help during divorce in New Jersey

Understandably, the divorce process can be one of the most stressful experiences of a person's life. This is true no matter how many or how few assets the parties share and have to divide during divorce proceedings in New Jersey. Keys to success include planning ahead and making rational decisions.

One way in which to make smart choices is to explore alternative methods to divorce litigation. Mediation is one common option to resolve disputes during divorce. In doing so, a couple utilizes a unbiased, neutral mediator to help them to negotiate an agreement. Each party also has the opportunity to consult with his or her own attorney during this process.

Another alternative to litigation is arbitration. In this process, the power lies solely with the arbitrator. Arbitration is ideal when both individuals have a disagreement about property division, for example, and are struggling to move past the deadlock but are okay with accepting another party's resolution of the issue as binding. This process can be less expensive than taking the matter to trial.

Divorce litigation can be costly and can drag out for months, or even years, thus only adding to the stress that typically comes with ending a marriage. However, alternative methods to divorce may help two divorcing individuals to more quickly and cost effectively achieve a solution that both find satisfactory. It is within the rights of both parties to pursue their personal best interests while still considering the other party's needs during a divorce proceeding in New Jersey.
