Mediation may streamline the divorce process

Conflict causes stress. How true these words may appear to people who find themselves in situations where they are exposed to high levels of conflict. This may be particularly relevant to New Jersey couples in the midst of a divorce.

Couples who wish to try and avoid or lessen conflict may benefit from considering mediation as an option. To accomplish this, both parties must buy into the concept and show a willingness to work toward an agreeable solution. Impartial mediators will help to resolve conflict and guide toward solutions for problem aspects such as division of marital property and/or child custody.

Mediation may cost less than litigation and may also expedite the divorce process. The length of the mediation process may vary and greatly depends on what kind of issues need to be resolved. The stated goal of mediation is to reach consensus on a fair settlement. Once the parties agree, a legal document will have to be signed, approved by the court and abided by. Mediation does not work in all circumstances, and when it doesn't, a couple will have to go to court to litigate open issues.

By making use of mediation, it is possible that the whole family may come out of the divorce process with little emotional harm.  While mediation may hold many benefits, such as protecting children and parents from the stress of the litigation process, reduction in legal fees and confidentiality, it is not always the best option. A New Jersey divorce lawyer is in the ideal position to evaluate individual situations and offer advice on the suitability of mediation or another approach.
